The city of Marietta notified owners of the Salon Q nightclub at 585 Franklin Road of plans for a hearing to possibly suspend or revoke the business's alcohol licenses after complaints the club is a public nuisance and sold alcohol to minors.
The city notified Mr. Romualdo A. Lopez and Ms. Idalyd Lopez, who operate La Bomba Latin Nightclub -- also known as Salon Q near Interstate 75 and South Marietta Parkway -- of the hearing scheduled for May 22 at 9:30 a.m. in the Council Chamber of Marietta City Hall.
The city's business license manager will conduct the hearing and receive evidence and determine whether or not to suspend or revoke the business's occupation tax certificate or license in accordance with 8-4-405 and/or 8-8-2-220 or the code of the city of Marietta, Georgia.
Marietta Police Chief Dan Flynn detailed reasons for the possible suspension or revocation of the licenses including violations of the following:
Marietta City Code 8-4-405 (B) (2) An applicant has knowingly allowed possession, use, or sale of controlled substances on the premises and/or knowingly allowed possession, use or sale of controlled substances to a minor on the premises;
Marietta City Code 8-4-405 (B) (3) An applicant has knowingly allowed the violation of an ordinance of the city or a violation of any criminal law of the State of Georgia (a misdemeanor or a felony) to occur on the premises; and that such violation is materially related to the operation of said business;
Marietta City Code 10-8-010 The following conditions may be declared to be nuisances when any one of them endangers the health, welfare or good order of the community:
(I) Any business or building where illegal activities are habitually and commonly conducted in such a manner as to reasonably suggest that the owner or operator of the business or building was aware of the illegal activities and failed to reasonably attempt to prevent the activities.
